What Is a Section 205 Application?

A short definition of the Criminal Procedure Act tool that compels production of bank and third-party records in South African fraud investigations — and why drafting quality is everything.

Key answer

A Section 205 application is a subpoena duces tecum under South Africa’s Criminal Procedure Act 51 of 1977 that compels a bank or other third party to produce specified records for a criminal investigation. Our target with proper drafting is bank records in 3–4 weeks (not yet measured); vague wording often delays cases 3–8 months in operational experience.

The definition

Section 205 of the Criminal Procedure Act 51 of 1977 empowers a judge, regional court magistrate, or magistrate to issue a subpoena requiring a person or institution to produce documents or give evidence needed for a criminal investigation. In fraud work, that almost always means certified bank statements, account opening packs, telecoms data, or company records held by someone who is not the accused.

The “application” is the papers the investigating officer files so the magistrate can issue that subpoena. Without it, third-party institutions generally will not release customer records into a criminal docket.

Why it matters for fraud cases

South African metros convict only about 4% of reported fraud. Many of those failures start here: detectives file vague Section 205 requests (“all records relating to the accused”), magistrates reject them, banks delay, and by month eight the complainant has moved jobs and the case collapses.

A precise schedule—account numbers, date ranges, document types, return date, and delivery instructions—turns the same legal power toward a 3–4 week turnaround target (not yet measured). Drafting quality is often the difference between conviction and write-off on a R4.5 million file.

Frequently asked questions

What is a Section 205 application?

It is the request for a magistrate or judge to issue a Section 205 CPA subpoena compelling a third party to produce specified records for a criminal investigation.

How long should it take?

Proper drafting: a 3–4 week target for bank records (not yet measured). Poor drafting: commonly 3–8 months after rejections and institutional delay, in operational experience.

Can the bank draft it for the detective?

The investigating officer files it, but complainants may prepare a precise draft. Better drafts raise approval rates and cut months of delay.
